Welcome to Blacktail Creative. By accessing this website or working with Blacktail Creative (“we”, “us”, or “our”), you agree to the following Terms of Service. Please read them carefully.
1. Services
Blacktail Creative provides creative services including, but not limited to:
Brand identity design
Logo design
Graphic design
Illustration
Print design
Web design
Creative consulting
Project scope, timelines, deliverables, and pricing will be outlined individually through proposals, estimates, invoices, or written communication before work begins.
2. Payments
Payment terms will be outlined in your project agreement or invoice.Unless otherwise stated:
Deposits are non-refundable
Final files and deliverables will not be released until payment has been received in full
Late payments may result in project delays or paused work
Blacktail Creative reserves the right to charge interest on overdue invoices where permitted by law.
3. Revisions
Projects include a specified number of revision rounds as outlined in your proposal or agreement. Additional revisions, changes outside of the approved scope, or substantial redesign requests may be billed at an hourly rate. Timely client feedback is required to maintain project timelines.
4. Client Responsibilities
Clients agree to provide:
Accurate information
Required content and materials
Timely approvals and communication
Rights to any assets supplied for use
Blacktail Creative is not responsible for delays caused by missing information, delayed feedback, or unavailable materials.
5. Intellectual Property
Final approved work becomes the property of the client upon full payment unless otherwise agreed in writing. Blacktail Creative retains the right to:
Display completed work in portfolios, social media, marketing materials, and case studies
Retain ownership of preliminary concepts, unused designs, drafts, and working files unless explicitly transferred.
Fonts, stock assets, plugins, and third-party materials remain subject to their original licensing agreements.
6. Website Projects
For web design projects:
Clients are responsible for ongoing hosting, domain registration, platform subscriptions, and third-party service fees unless otherwise agreed
Blacktail Creative is not liable for platform outages, software updates, third-party integrations, or hosting-related issues
Once a website is launched and approved, ongoing maintenance is not included unless part of a separate agreement.
7. Print & Production
While every effort is made to ensure accuracy, Blacktail Creative is not responsible for:
Printing errors after client approval
Colour variation between screens and printed materials
Vendor, shipping, or production delays
Third-party printing defects
Clients are responsible for carefully reviewing all proofs before approval.
8. Cancellations & Project Suspension
Either party may terminate a project in writing. If a project is cancelled after work has begun:
Deposits remain non-refundable
Clients are responsible for payment for work completed up to the cancellation date
Projects inactive for extended periods may be archived or subject to restart fees.
9. Limitation of Liability
Blacktail Creative shall not be held liable for any indirect, incidental, special, or consequential damages resulting from the use of our services, website, or deliverables. Our total liability shall not exceed the total amount paid by the client for the applicable project.
10. Website Content
All content on this website, including text, graphics, branding, and artwork, is the property of Blacktail Creative unless otherwise stated and may not be copied, reproduced, or distributed without permission.
11. Third-Party Services
This website may contain links to third-party websites, tools, or services. Blacktail Creative is not responsible for the content, policies, or practices of any third-party websites or services.
12. Changes to These Terms
Blacktail Creative reserves the right to update these Terms of Service at any time. Changes become effective immediately upon posting to this website.
13. Governing Law
These Terms of Service are governed by the laws of the Province of British Columbia and the applicable laws of Canada.
